Brandon Boxler Discusses the Firm’s Efforts at U.S. Supreme Court in Important Fourth Amendment Case

In a front-page story featured in the Daily Press and the Virginian-Pilot, Richmond partner Brandon Boxler discusses the firm’s recent petition for a writ of certiorari in Futrell v. Commonwealth of Virginia.

The case started when police conducted a warrantless search of the digital data on a cellphone left at a restaurant. Finding that the phone had been “abandoned,” a Virginia appellate court held that the search did not violate the Fourth Amendment. This holding deepens divisions among lower courts concerning when, if ever, a person abandons the digital contents on a cellphone.

Klein Thomas & Lee appellate attorneys Brandon Boxler and Ian Edwards filed a petition for a writ of certiorari asking the U.S. Supreme Court to review the case and bring much-needed clarity to this important issue, which has implications for the privacy rights of all Americans.
